Privacy Policy

cutsmart („cutsmart", „we", „us") is an AI video-editing assistant for Final Cut Pro, provided by Gillian Scharf (Vienna, Austria). This Privacy Policy explains what data cutsmart processes, why, and what your rights are. cutsmart is built to be private by design.

What we process, and why
To turn your raw footage into a finished Final Cut Pro timeline, cutsmart processes:
Audio from your video clips. cutsmart extracts the audio and sends it to our service to be transcribed (speech-to-text), so it can detect silences, retakes, filler words and structure. Processed via OpenAI's transcription API.
One still frame per B-roll clip. A single frame is sent to generate a short visual description, so cutsmart can place B-roll sensibly. Processed via OpenAI's vision API.
The resulting transcript, sent to Anthropic's Claude API to decide story order, which retakes to remove, titles and chapter markers.
Your subscription identifier. To confirm you have an active subscription, the app sends a subscription token, an Apple App Store transaction (StoreKit) or a license key (direct version), to our service for validation.
Minimal technical data. Our service counts requests per subscription (a daily cap) to prevent abuse. We do not build user profiles.
What we do NOT process
Your video files, they are never uploaded; they stay on your Mac. No name, email address or account (there is no login). No location, contacts, photo library, advertising identifiers, or cross-app tracking.
Who processes data on our behalf (sub-processors)
Cloudflare, hosts the processing service that relays requests. OpenAI, transcription (audio) and image description (B-roll frame). Anthropic, editing decisions generated from the transcript. Apple (App Store version) / Polar (direct version), subscription billing and validation. We never receive your full payment details. These providers process data under their own privacy terms. Per their API terms, content sent to OpenAI and Anthropic via the API is not used to train their models.
Retention
Audio and still frames are transmitted only to provide the editing service and are not retained by us beyond what is needed to return the result. We do not use your content to train any models, and we do not sell it. Our providers retain API data only briefly, per their own policies.
International transfers
Our providers (Cloudflare, OpenAI, Anthropic, Apple) may process data on servers outside the EU/EEA, including the United States. Such transfers rely on appropriate safeguards (e.g., Standard Contractual Clauses) as required by the GDPR.
Legal basis (GDPR)
Performance of a contract (Art. 6(1)(b)), processing the audio/frames of your footage is necessary to provide the editing service you requested. Legitimate interests (Art. 6(1)(f)), validating subscriptions and preventing abuse.
Your rights
If you are in the EU/EEA (or a comparable regime), you have the right to access, rectify, erase, restrict or object to the processing of your personal data, and the right to data portability. To exercise any right, email support@cutsmart.ai. You also have the right to lodge a complaint with your local data-protection authority (in Austria: the Datenschutzbehörde).
Children
cutsmart is a professional tool and is not directed at children under 16.
Changes
We may update this Policy. Material changes will be posted here with a new „Last updated" date.
